Selling to California residents from C&R FFL |

I am starting to understand why some WTS posts I have seen state they will not sell to California residents. I recently put a Remington 511 on an auction site
and a California resident was the high bidder. My buyer's first FFL-01 told him that I had to include approval from the California Department of Justice
along with my FFL. I went to the prescribed web site to apply for approval. I kept getting told that my FFL was invalid. A phone call to the CADOJ on Monday
told me that that only FFL-01s have to apply with the CADOJ. Does this fit with your experience or is something else going to come up with this?

Don,
Your 01 there in CA is incorrect. An individual does not have to be on their list, have paperwork, etc. Only 01 dealers have to have all of the paperwork/approval crap. You'll need a copy of their license and send a copy of yours, that's it. Be prepared to have your clock cleaned on shipping and insurance too. This based on my experience selling to CA. It's a hassle and it's expensive and has really soured me on offers from buyers in CA, even for accessories. Nothing personal CA residents. But it truly is an expensive pain in the butt to get anything there, firearms or otherwise.

Chuck, that is exactly what the plan is. The harder and more expensive the liberals in our Legislature can make it to participate in our hobby, the more
people will just give up and go to something else. The fewer of us there are, the easier it will be for them to put an end to anything firearms related in the
state. They are nefarious, not stupid. Every time someone says I won't sell to California these days, it is a win for the Anti-Second Amendment,
Anti-Hunting (and Fishing) element in the state.

I am a CA C&R FFL. Was the gun sold a C&R rifle or C&R handgun?
If the CA buyer is not a C&R FFL (and not, of course, an FFL Dealer), then it must be shipped to a CA Dealer FFL. Here's from the CA DOJ website: 5) I am an FFL located outside of California. I ship/transfer firearms to California FFLs. Am I affected by the California Firearms Licensee Check (CFLC) Program? Yes. You must obtain a Firearms Shipment Approval number from CADOJ Bureau of Firearms prior to delivering a firearm to a California FFL. Consequently, you will need to enroll in the CFLC program to obtain Firearms Shipment Approval numbers prior to shipping firearms to California. (http://ag.ca.gov/firearms/cflcfaqs.php#3)I know - Just one more of many hoops to jump through. Trautert is right - They are incrementalling us. We are fighting back though. The CalGuns.NET Foundation is slowly starting to turn the tide - in my view. We are "under seige" in this state, and anytime another firearm gets shipped legally into this state, it's a small win for us. Thanks for listening... quiet-wyatt

Wyatt, Tom, I respect and understand your situation.
I don't agree with the nanny-statism that is going there, but that's not for this forum. As an individual that just happened to post a few things for sale back in January, I went through the entire dog and pony show to get a MAS 49 to CA. Heck, I even e-mailed Tom for the low down just to make sure what I was reading/interpreting at the CADOJ & Calguns.net website and the goofy semi-automatic flow chart of legality was correct, as inane as it was. More aggrivating than the rules & requirements and having to sift through them myself to make sure I wasn't committing a crime by selling to CA, was the outrageous shipping fee incurred to mail it to a shop there, insured with delivery confirmation. That was the straw that broke my willing to ship at my "shipping included" prices anywhere past the mighty Mississippi River. Since it was going across the entire width of the US, I over-wrapped the package as the 49 was near mint/perfect and didn't want to eat the loss should the buyer receive a damaged piece, thus I paid for it in weight/distance charges that ate through $43 and change that should have been pocket money. So I'm griping about the cost as much as I am about the extra work involved/required to get something there. To sell a sling I paid $10 for at $14 shipped and have to pay $9 in mailing costs is not productive in the least. The MAS C&R piece went to a non-C&R holder via an 01 dealer in CA. It is/was my understanding that a C&R holder or individual outside of California isn't required to have an approval number to ship something into that state to an 01 dealer. As for me, an individual that sold a few duplicate rifles to cover the cost of getting a few new pieces, it was totally not worth the effort/hassle/aggrivation that I went through to get it there, then got my wallet kicked hard on the shipping fees in the process. That's all I'm saying, not trying to go on an anti-sell to CA rant. We need to vote the scoundrels out, repeal the stupid "feel good" laws and get on with life, at the local, state and national levels.

Yes, it is a hassle, and I for one don't hold anything against someone who doesn't want to ship to CA. I don't think I would want to if I was outside of CA. All I try to do is to inform a seller that if something is legal and I want to buy it, I will give them the info needed if they wish to pursue it. I live here, and I go off on a anti-CA rant on a regular basis! Thanks for listening, quiet-wyatt |

No matter who we vote into office, California is still going to be a thousands of miles away from West Virginia. But we are more than willing to pay shipping
charges here. I have never asked a seller to ship something for free, unless it was Century Intl.
