Question about selling a firearm without a license |

Greetings all. Hope someone can/will help me out. I used to frequent this site years ago, but have let my interest in C&R collecting slip as I've
taken on other interests (Competition Shooting). I'm going to be thinning my (C&R) herd to help finance a new rifle. Alas, I let my License lapse
several years ago, so if I were to list some of my C&R items here on the WTS section, or on an auction site, how would I go about LEGALLY finalizing the
sale/shipping now that I no longer have a License? Can I ship straight to a C&R holder? To a 01 FFL? Would it have to be FFL (Here) to FFL (There)? All
items would be C&R. Also, how would I close out my Bound Book for those items I sold? Thanx.

As far as Federal ATF regs go, any unlicensed individual in any state can legally ship a firearm TO a FFL-01 dealer (or, if it is a C&R-qualified firearm,
a FFL-03 collector) in any state. Check your own state's reg's as some states have tighter regs than the feds. Before you ship, you will need to
receive a signed copy of the FFL of the dealer or collector that you are shipping to, so that you can verify that you are actually shipping TO a licensed FFL.
Be aware that some FFL's will refuse to send a copy of their FFL to anyone other than another FFL, because they just don't fully understand the
reg's.

You don't have to record anything in your bound book. That requirement ended as soon as you became unlicensed.
Also, since you are unlicensed, there is no requirement that you get a copy of the FFL's license before you ship. It's a good idea to ask for a copy, but it is not required. Many Type 01 FFL's don't like to give out copies of their license unless they have to, but most Type 03 FFL's will have no problem sending you a copy. You will need to at least get the FFL's license number so you can verify that it is a valid FFL and that the shipping address matches the license. For Type 01 FFL's you can verify the license number at BATFE's EZ-Check web site. For Type 03 FFL's you will need to call the Federal Firearms Licensing Center and verify the license over the phone.
